Refund Policy
Effective Date: June 23, 2009
IMPORTANT NOTICE
Do not attempt to access or use the output from this web service unless and until you first have read, understood and agreed to the terms of the Deadlines On Demand, LLC (DOD) Terms and Conditions of License Agreement, Terms of Use, and Privacy Policy, and completed in full the registration information for this web service. Use of this web service or reliance on the output from this web service by unlicensed, unregistered or unauthorized users is strictly prohibited, and under no circumstances will DOD or any of its affiliates have any liability of any kind or nature or issue any refund amounts for any such unauthorized usage.
DOD typically presents the most conservative date calculation result in instances where two possible results may be obtained. DOD will not refund service fees for such conservative date calculation results. Amounts charged and paid for this web service are not refundable except under the following policy guidelines:
REFUND POLICY:
DOD will only consider refunding service fees in very narrow circumstances described below. If a licensed, registered, authorized user (“Authorized User”) has received output information from DOD web service that he/she believes is incorrect, that user must adhere to the following policy guidelines in order to have his/her refund request considered:
The refund request is being made due to a clerical or billing error.
If the Authorized User is requesting a refund due to a clerical or billing error, the quickest way to resolve this issue is by calling DOD’s support staff at (888) 363-5522 or by sending an email with the details of the issue to our Support Department.
The refund request is being made due to an issue other than a clerical or billing error.
The Authorized User should send an email to our Support Department containing the following specific information: (1) The specific reason that the Authorized User believes that he/she is entitled to a refund, (2) The specific authority or authorities that the Authorized User is relying upon in making his/her request, and (3) Confirmation that the Authorized User has considered any and all holidays or court furlough days that may have impacted the results provided.
The DOD support department will investigate each claim received from an Authorized User. After investigating a claim, DOD will notify the user submitting such claim whether it believes such user is due a refund. If the user has claimed that he/she is due a refund as a result of a miscalculation of any court deadline or other date, and DOD determines that the user is not entitled to a refund, DOD will confirm, in writing, the accuracy of the DOD results to the user. If the DOD support department deems that in order to investigate the user’s claim DOD must do research, the user will be notified of the charge that would ensue for such research, and the user will then need to e-mail his/her permission to DOD to proceed, along with agreement to pay the charge for such research if the user’s claim is not correct in DOD’s sole discretion. If the DOD support department, in its sole discretion, determines that the user’s claim is correct, the charge for research will be refunded. If research was necessary and authorized by the user, and if the DOD support department determines through such research that the user’s claim is accurate, there will be no research charge and the user’s initial service charge will be refunded.
If, after receiving confirmation from DOD of the accuracy of any output result, the user still requests a refund, DOD, in its sole discretion, may refund some or all of any charge, and also reserves the right to cancel the user’s license to obtain further web services from DOD.
Please note that DOD will not be responsible for (including by providing any refunds to a user or otherwise) any technical difficulties that interfere in any way with a users access to or use of the output from this web service, other than any technical difficulties that result solely through the fault of DOD. Only if such technical difficulty arose solely through the fault of DOD will DOD refund a user his/her service charge.
